§ 802. CONTAMINATION OF GROUNDWATER PROHIBITED.

  • It shall be unlawful for any person to construct, modify, operate or maintain a well or soil boring which presents a substantial risk of groundwater contamination due to the current or past presence of pollution from any source, even if the well or soil boring may be properly constructed, operated or maintained, except in the case of
    (a) Monitoring wells used for the purposes of observing or monitoring groundwater conditions.
    (b) Extraction wells used for the purpose of extracting and treating water or soil from a contaminated aquifer.
