§ 56.13. DETERMINATION BY COMMISSION.

- (a) Public Hearing. The Commission shall hold a public hearing to consider and act on a proposed development agreement after providing notice as required under Section 56.8.(b) Recommendations to Board of Supervisors. Following the public hearing, the Commission may approve or disapprove the proposed development agreement, or may modify the proposed development agreement as it determines appropriate. The Commission shall make its final recommendation to the Board of Supervisors which shall include the Commission's determination of whether the development agreement proposed is consistent with the objectives, policies, general land uses and programs specified in the general plan and any applicable area or specific plan, and the priority policies enumerated in City Planning Code Section
101.1 . The decision of the Commission shall be rendered within 90 days from the date of conclusion of the hearing; failure of the Commission to act within the prescribed time shall be deemed to constitute disapproval.(Added by Ord. 372-88, App. 8/10/88)
